Why won't Obama just hand over his birth certificate?

This whole issue is just too bizarre to really believe that it could be true. Indeed, I feel as if this whole thing is some type of setup to make critics look like kooks right before the election. The claim is that Obama is not qualified to be president because he is not a natural-born citizen of the US -- that Obama does not actually have a birth certificate from Hawaii. That said, Obama's response is puzzling. Instead of just handing over his birth certificate, they have filed a protective order to prevent people from observing what is going on in the case and moved to dismiss the complaint. The other thing that is very strange is that the lawyer who filed it, Philip J. Berg, was a former Democratic deputy Attorney General for the state of Pennsylvania. Country is Headed to a Constitutional Crisis

(Lafayette Hill, Pennsylvania – 10/06/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that Obama and Democratic National Committee [DNC] filed a Joint Motion for Protective Order to Stay Discovery Pending a Decision on the Motion to Dismiss (which was) filed on 09/24/08.

While legal, Berg stated he is “outraged as this is another attempt to hide the truth from the public; it is obvious that documents do not exist to prove that Obama is qualified to be President.” The case is Berg v. Obama, No. 08-cv-04083.

Their joint motion indicates a concerted effort to avoid the truth by attempting to delay the judicial process, although legal, by not resolving the issue presented: that is, whether Barack Obama meets the qualifications to be President.

It is obvious that Obama was born in Kenya and does not meet the “qualifications” to be President of the United States pursuant to our United States Constitution. Obama cannot produce a certified copy of his “Vault” [original long version] Birth Certificate from Hawaii because it does not exist.


UPDATE: I just want to emphasize what I wrote earlier: "Indeed, I feel as if this whole thing is some type of setup to make critics look like kooks right before the election." I really worry that this is a type of trap to discredit and demoralize those who oppose Obama.

UPDATE 2: For whatever it is worth, here is a rather long rambling discussion from the lawyer who has brought this lawsuit against Obama. I had no confidence before with this guy, and I have no more confidence with him after listening to this. My only questions are: What motivated this guy? Was he in league with the Obama people? (It is about one crazy thing that would explain why Obama wouldn't turn over his birth certificate.) Or was he simply a prominent Dem who went a little crazy? I don't know, but the whole thing seems very strange to me.

Why do seemingly intelligent people continue this sort of silliness? Regardless of where Obama, or McCain, or Barry Goldwater or numerous other candidates might have been born, as long as at least one of their parents was a US citizen at the time, they are ipso facto natural-born US citizens who upon reaching the age of 35 are constitutionally eligible to become president if elected.

Factcheck.org supposedly saw a certified birth certificate and has pictures. I know they've been a little sketch on some other issues, but are they that far off on this one? It seems like it should be pretty simple.

I've wondered the same thing & have come to the conclusion that BHo just doesn't care. I'm sure he feels that if he is not a legitimate citizen, then he should be because he is the annointed one & the rules are for the rest of us mortals.

It's all propaganda anyway - any time his name is brought up he wins; good or bad. Just like the nuts that kill people - they get press & they are happy.

Actually, it DOES matter where BHO was born. Under the laws in effect at the time of his birth, if (1) BHO's father was not a US citizen and (2) BHO was born outside the US and (3) BHO's mother had not LIVED IN THE US for 5 years AFTER REACHING AGE 16 (I think it was), then the child was NOT a US citizen by birth. Obama's mother gave birth when she was 18, and so simply could not have met the 5 year residency requirement of the law.

(I'm not at my regular computer and don't have the link to the statutes - sorry.)

John may be right - this may be a setup. But IF there is no valid HI birth certificate, then it may truly be a question of Constitutional significance.

I have a hard time believing that you actually read what I wrote. Here is the question: why won't Obama turn the birth certificate over to the court? Look this is a prominent Democrat lawyer bringing this lawsuit. Please answer the question since that was the whole point of the piece. Finally, again, I wrote:

Believe what you want, but your post tapdances and tiptoes around the underlying assertion that Obama is not American. I provided proof to refute that underlying assertion from your post and explicit assertion from other comments. Whether or not this is a setup or a trap, I don't care. I care about facts. The fact is Obama was born in Hawaii, he is an American citizen, and has a birth certificate to prove it. The rest of the talk in this entry is static.

I just stumbled onto your site Mr. Lott. So far, im enjoying what i see. This post of yours has me wondering tho. Youre obviously bright enough and certainly educated enough to realize no sane human being let alone a large group of individuals, would devote the huge personal and financial resources to getting elected president without being certain on this basic eligability question. Even tho you attach your "set-up" caveat,it still smacks somewhat of the typical world wresting league type of writing designed to attract the attention of your base conservative readers that are looking for anything to hang their paranoid hats on.

With a prominent Democrat bringing the lawsuit and Obama not turning over a document, the whole thing seems extremely strange to me. I would just be interested in your take about why Obama won't give this certificate to the court. Again, why?

It's political posturing on both sides. If Obama "gives in", then he is dignifying this baseless claim with a response (side note: why isn't McCain under investigation for being born in Panama?). If he doesn't "give in", then it looks like he has something to hide, regardless of his attempts to debunk the slander early on in this political process.

As for political party labels, they're all completely meaningless. Joe Lieberman is a "Democrat", right? 'nuff said.

This is all a distraction; it's noise, it's static. Obama -- a.k.a "that one" -- is legally qualified to seek the Presidency. End of story. Now, how about discussing the issues, hm?

I thought Derek answered the question very well. I hadn't even heard about this suit. Could it be that pesky biased mainstream media elite? Or is it that the only people that might be worried Obama isnt legally qualified are the same ones who are convinced UFO's really ARE travelling incalculable distances for the sole purpose of popping in and out of grainy film footage occasionally, without even a simple wave hello. It's nonsense.
Some ask why, while others ask why bother.

It's undignified to respond to smears. It's undignified to have to prove your citizenship beyond the means all Americans are subjected to (a birth certificate, just like the one he already provided months ago).

But if you must, if you insist, then let's apply the same standard to McCain. He was, after all, born in Panama. So let's bring a lawsuit against him, demand more than his birth certificate, and further try and distract the already weary constituents from the real issues at hand and the troubles facing us all.

John McCain was born of military parents stationed in Panama during his father's service, thus automatically giving him status as an American citizen as it does with all other military dependants bron on foreign soil, on or off military installations. Therefore your argument is null and void.

John:

Obama won't turn it over because he is Obama. He doesn't do any wrong, he caters to no one, and cries foul at every finger pointed towards him until it's lowered. He reminds me of a whiney kid that won't shut up. Give in to Obama and he gets quiet. He's run his entire election that way. He attacks McCain, the cries foul when McCain attacks back, saying McCain just wants to tear him rather than worry about the country. Where is the press on that one?

As for the attack ads, you must be drinking the (Republican) red Kool-Aide and ignoring the dirty and slanderous tone McCain has taken, especially in the last week. He realized he's losing on the issues, losing on American confidence, and losing on most other fronts. So he's gone back to smearing Obama, running attack ads about Ayers, and ignoring the issues completely.

It's called a Hail Mary, a shot in the dark, a last-ditch attempt at salvaging his poorly-executed campaign.

He wouldn't even shake Barack's hand at the end of the debate on Tuesday. It's pathetic, really, to see a man who once stood with honor, slowly succumb to the dark side.

I'm a democrat and plan to vote for Obama. BUT, I agree here, he damn well shouldn't be dodging this like a sissy...stand up and expose the damn truth. It's just too damn fishy to hide on something that is this big. I will be damn pissed if it comes out that the dude lied and a ton of top dems were complicite in the whole thing. This is a constitutional issue...YOU CAN'T RUN IF YOU DON'T QUALIFY!

Yes, and if we had just accepted the Dan Rather story who knows how that would have ended.

Nice try.

For all we know that document could have been forged.

If BO has the original he should turn it over.

It is a PREREQUISITE to running for President.

In any other context of application, any prerequisites must be turned over for verification before you can be accepted.

In any case, if people would similarly bring lawsuits against John McCain and demand that he also produce the physical copies of his birth records, then I don't have a problem. But I don't believe I've read anyone apply the same criticism or level of inquiry to John McCain. So folks support equality in this regard, it will continue to look like an underhanded, racially-tinged attack at Obama.

You're singling out Obama because you want to distract the process even further from the issues. You're starting to realize that McCain is likely to lose and are grasping for straws.

This website's lean, its author, and most of its responders are decidedly right wing after reading a number of posts and comments, so I don't expect much of what I say to actually register with most of you. But I feel it's worth saying. You want to attack Obama? Fine. Do it on the issues, the things that really matter. Not by bringing up the ghost of McCarthy with slander about Obama being anti-American, not "one of us", and general fear-mongering.

However, YOU attempt to distract by turning the POV to McCain.

We're not talking about McCain's birth cert we're talking about BO's.

If you want to have a separate discussion about such, fine.

This is the tactic of dems/libs and those of victim mentality, point to another's behavior when you are losing the argument.

Simply produce the item in question and all goes away.

This cat-and-mouse game just adds further discourse and observation alone of BO's pattern of behavior can only lead one to determine his dishonesty.

Again, in a court of law, this nation founded on the rule of law, BO being a lawyer, this should be a no brainer - produce the item and the story goes away.

There have already been a couple of lawsuits regarding John McCain's eligibility to run for president. They were all thrown out. He was born to military parents stationed elsewhere. That's why he's not being questioned.

Obama on the otherhand has provided what several independent analysts have determined to be a FAKE birth certificate. A picture was posted on a website...once people started noticing it was forged, they replaced it with a smaller fuzzy copy. Now Obama won't provide his birth certificate for a lawsuit? He's blocking discovery...of his birth certificate. You don't find that fishy? If you were running for president, wouldn't you just simply turn it over to the judge and move on with your life. That's what I'd do.

Some of you think it is undignified to respond? Are you kidding me? I guess there could be some absurd reason why he won't turn it over...but I can't think of a GOOD reason.
